The Legal Aspects of Apartment Law
How to proceed with the apartment right?
Our highly regarded Legal Specialist and former notary public, Master Carlo Jadnanansing, has been awarded an honorary doctorate in 2019 for his outstanding achievement in scientific and social fields.
Mr.
Jadnanansing will highlight the legal aspects of Apartment Law.
The current Civil Code (BW) of Suriname was introduced on May 1, 1869.
The need for adaptation of the current BW to the social reality has led to the draft New Civil Code (NBW), in which essential innovations and improvements have been made. This draft NBW also includes the Right of Apartment in Book 5 Title 9. After the New Adapted Civil Code comes into effect, this Apartment Law will finally allow for the construction of Apartment Complexes in Suriname.
Why don’t we have an Apartment Law yet?
An article [1] by Meester Jadnanansing, published on June 27, 2016, details the reason(s) why the Apartment Law Act has not yet been adopted in Suriname.
According to this article, the Draft New Civil Code (ONBW), which was submitted in 2009, has not reached The National Assembly, at least not in the official way.
The draft was submitted to the then President in 2009 through the then Minister of Justice.
In 2011, the draft was presented again, this time to the new President (after the 2010 elections).
According to the information in the article, the then President asked to see if the draft needed to be adjusted to the changed circumstances.
Ground Congress 2021
During this Land Congress, Master Jadnanansing will elaborate on the legal aspects of the Apartment Law Act, and how this Act can be submitted to The National Assembly for consideration (without doing so integrally with the NBW).
